Data Protection Policy of Kombiverkehr Deutsche Gesellschaft für kombinierten Güterverkehr mbH & Co. KG

A.     DATA PROTECTION POLICY

We, Kombiverkehr Deutsche Gesellschaft für kombinierten Güterverkehr mbH & Co. KG (Kombiverkehr), operate the website www.kombiverkehr.de (Website).

It is possible in principle to visit our Website without registering. Certain personal data will be collected automatically, however, and we will need other personal data from you in order to perform and provide the specific range of products and services we offer you.

We would like to inform you at this point of what personal data we will collect during your visit to our Website and for what purposes these data are used.  You will find a declaration of consent pursuant to data protection law in section B below.


1.    Collection, processing and use of personal data:

1.1.    Usage data:
Our web servers will automatically save the following usage data during your visit to our Website:

  • The website through which you accessed our Website
  • Date and time of the page view
  • Your IP address

These usage data will be collected automatically and anonymously. We will not use your IP address to identify you. However, the usage data will help us to obtain information about how our Website and the range of products and services on our Website are used and will give us the opportunity to improve the range and rectify errors.


1.2.    Inventory data:
When you register for specific services, offers and benefits, we will ask you to provide us with some personal details, e.g. name, postal address, contact details etc. You are free to some extent to choose which of these personal data you provide.

We will, however, require user data insofar as these are mandatory (e.g. email address, name) to enable us to provide the services, offers and benefits requested by you.

We collect, process and use personal data for the following purposes:


a.    Making contact by email
Should you use the contact form on our Website to get in touch with us, the details you provide on the form will be saved in order to deal with your enquiry and to answer any subsequent questions.


b.     myKOMBIVERKEHR
You must first register with us by opening a myKOMBIVERKEHR account in order to use the various services, offers and benefits on our Website.

We will ask you for the following personal details in order to register for your myKOMBIVERKEHR account:

  • Surname, forename, title
  • Telephone, email address
  • Company
  • Position in company
  • Postal address of company
  • Password for protected access

You are free to some extent to choose whether to provide these details. We collect, process and use these data to enable us to provide and administer the services, offers and benefits you require on our Website. A double opt-in process is used to register for myKOMBIVERKEHR, i.e. we will send an email to the email address provided by you with a request to reconfirm your registration. You may make use of the services we provide once you have registered for the myKOMBIVERKEHR account.

You may cancel your myKOMBIVERKEHR account at any time if you no longer wish to make use of our services, offers and benefits. We will cancel your myKOMBIVERKEHR account if you send us a request to this effect by email to info@kombiverkehr.de.


c.    "KOMBI-BRIEF" newsletter
If you subscribe to our "KOMBI-BRIEF" newsletter, we will use the personal data you provided when registering for your customer account.

You may unsubscribe from the KOMBI-BRIEF at any time by clicking on the relevant link which is shown in every KOMBI-BRIEF.


d.    Downloading photographs and videos for cultural, journalistic and educational purposes
We will make selected Graphic Materials, photographs and videos (media data) available for download free of charge to a defined group of authorised persons for cultural, journalistic and educational purposes in accordance with our Terms of Use.

In order to ensure that you are entitled to download media data free of charge and use them in accordance with our Terms of Use, we will ask you for the following personal details before you download our media data in print quality:

  • Surname, forename
  • Which authorised group of persons you belong to
  • Intended usage  
  • email address

We require these personal data and details from you so that we can verify whether you are authorised to conclude a contract on the free usage of the media data. We also require these data from you so that we can document and administer the user contract and check compliance with the Terms of Use.  


2.    Information / product recommendations / market research and opinion surveys
If you agree, we will also use the personal details you provide when using our Website to contact you by email or letter for the following purposes:  

  • Sending information about our services, offers, benefits and events
  • Recommendations for our services, offers and benefits
  • Market research and opinion surveys aimed at optimising our services, offers and benefits

Please indicate your consent for your email address and postal address to be used for sending information and product recommendations by placing a tick in the appropriate box. We will keep a record of your consent.

You may also revoke your consent at any time with future effect by sending an email to info@kombiverkehr.de.  

If you agree to your personal data being used in these ways, we will not be obliged to delete your usage data as soon as you stop using our services, offers and benefits. We will be entitled to continue to store and use your data for the aforementioned purposes.


3.     Security measures to protect our stored data
Insofar as we collect personal data, we will save these on specially protected servers in Germany or in the European Union. Access to such data is limited to a few authorised persons with special technical, commercial or editorial responsibility for them. In order to prevent the loss or misuse of data, we have comprehensive technical and operational safety precautions in place which are monitored on a regular basis and duly modified in line with advances in technology. Owing to the structure of the internet, however, we would also point out the possibility that other persons outside our area of responsibility and institutions may fail to observe data protection regulations and the aforementioned safety measures. In particular, third parties may also read data divulged without being encrypted, even if this is carried out by email. We have no technical control over this. It is your responsibility to protect the data with which you provide us against misuse by means of encryption or in some other way.


4.     Use of cookies
We use cookies on our Website to enable us to offer you an extensive range of functions and make our Website easier to use. 5.     Transmission to third parties

Insofar as Kombiverkehr uses third-party companies for data processing in order to fulfil its obligations to you (contract data processing), such companies will be obliged to handle your data with care with due regard for the requirements of data protection laws and in accordance with our instructions, and not to use them for their own purposes or forward them to third parties.


6.     Use of Google Analytics
6.1.    Data are collected and stored on this Website by Google Analytics, a web analysis service provided by Google Inc. ("Google"), and used to create usage profiles by means of pseudonyms. The purpose of these usage profiles is to analyse visitor behaviour so that our offering can be improved and attuned to requirements.

Google Analytics uses cookies, which we have described in Section 4 above.

The information generated by the cookies about your use of our Website will generally be transmitted to Google servers in the USA and stored there. In accordance with statutory data protection provisions, however, your IP address will be abbreviated beforehand by Google within Member States of the European Union and in other signatories to the Treaty on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and abbreviated there. Google will use this information on behalf of the operator of this Website in order to evaluate your use of the Website, compile reports on Website activity and provide other services relating to Website activity and internet usage to the Website operator. The IP address transmitted by your browser in connection with Google Analytics will not be associated with any other data held by Google. The pseudonymised usage profiles will not be associated with personal data relating to the holder of the pseudonym without the express consent, to be issued separately, of the party concerned.

6.2.    You may prevent the installation of cookies by using an appropriate setting in your browser software (see section 4 above). However, please note that if you do this, you may not be able to use the full functionality of this Website.

6.3.    You may also disable Google Analytics on your monitor and your computer, i.e. you can prevent Google from recording the data generated by the cookie in relation to your use of the Website (incl. your IP address) and from processing these data by downloading and installing the Google browser add-on available under the following link:

The web analysis function will remain disabled until this Google browser add-on is disabled or deleted. The browser add-on is needed on both the browser and the computer. If you do not wish to have a web analysis function, therefore, you must add the browser add-on to all the browsers and computers in use.

Browser and operating system updates may affect the installation and functionality of the browser add-ons.

6.4.    Google Analytics has been extended by the code "gat._anonymizeIp();" on this Website in order to ensure that  IP addresses are always anonymised to prevent direct reference to individuals (IP masking).

6.5.    If you have not refused to consent to the use of cookies (see section 4 above) or have not installed the Google browser add-on, we assume that you agree to our arrangement for Google Analytics to analyse the use of our Website in the aforementioned way and to process the data collected about you.
 

7.     Hyperlinks to external websites
Our Website has hyperlinks to websites operated by other providers. In such cases you will be transferred directly from our Website to the website operated by another provider. You will recognise this by the change of URL, among other things. We cannot assume responsibility for the confidential handling of your data as we have no control over whether these companies comply with data protection regulations. Please refer directly to the websites of these companies for information on the handling of your personal data.


8.     Right of information and right of revocation
You may obtain information free of charge at any time about your personal data held by us, including origin, recipient and purpose of data processing. You may have your personal data held by us blocked, amended or deleted, and you may refuse to consent to anonymised or pseudonymised data collection and storage for the purpose of optimising our Website. You may also revoke the consent you have given us to collect and use data at any time without stating reasons for doing so.

9.     Changes to the Kombiverkehr Data Protection Policy
The legal frameworks in which we act as service providers are subject to changes and amendments. From time to time, these changes and amendments require the Data Protection Policy to be updated. Kombiverkehr therefore reserves the right to amend this Data Protection Policy.
